These are the general terms of use for Photoline: The New Zealand Railway Photo Archive website. These terms are between Photoline: The New Zealand Railway Photo Archive (NZBN:9429053684370) (“we”, “us”, “our” or “The Photoline Archive”) - who administer the site - and users of Photoline: The New Zealand Railway Photo Archive website (“you”, “your” or “user”).

User Account Termination
You may choose to terminate your account at any time.
Any pre-paid subscription fee will not be refunded.
When your account is terminated, personally identifiable data for your account is removed from our databases and cannot be recovered.
Any files uploaded to The Photoline Archive will remain available.
The Photoline Archive will retain any information you provided with a file upload. For instance, if you have entered your name as the photographer, this will remain associated with the record.
Contributing Content
The Photoline Archive is not responsible for content contributed by users. User-contributed material may not always be accurate or complete, and users should independently verify information before relying on it.
Contributed content must not:
• infringe intellectual property, privacy, or other legal rights;
• breach any applicable law, court order, or suppression order; or
• contain deliberately inflammatory, abusive, deceptive, or misleading material.
Contributed content may be made available to third parties under the Creative Commons licence (or other licence) applied to that content. Licence details are displayed on the relevant Record Page.
The Photoline Archive reserves the right to remove, edit, restrict, or otherwise manage contributed content and user-contribution features at its discretion, including where content is considered to breach these Terms and Conditions. Accounts that violate these Terms and Conditions may also be suspended or terminated.
Where reasonably possible, The Photoline Archive will provide notice of significant changes affecting contributed content or user-contribution features through announcements published on the website.
Content uploaded to The Photoline Archive becomes part of the New Zealand Railway Photo Archive Collection and may remain within the archive even if the contributing User Account is suspended, terminated, or deleted.
By uploading content, you confirm that:
• you own the content or have permission to upload it;
• you have the right to grant the permissions outlined in these Terms and Conditions; and
• the content does not knowingly infringe the rights of any third party.
By uploading content to The Photoline Archive, you grant The Photoline Archive a perpetual, non-exclusive licence to store, reproduce, display, publish, and distribute the material as part of the archive and its associated services.
The Photoline Archive does not claim ownership of copyright in contributed material unless otherwise stated. Copyright remains with the uploader, photographer, or other copyright holder unless the copyright term has expired under applicable law.
High-resolution versions of images may be made available through paid access services to help cover the operating and storage costs of the archive. By uploading content, you agree that The Photoline Archive may charge users for access to high-resolution copies of your images.
Contributors are not entitled to royalties, commissions, or other payments arising from fees charged for access to high-resolution images.
You agree to indemnify and hold harmless The Photoline Archive against claims, liabilities, damages, or expenses arising from content you upload or contribute.
The Photoline Archive provides a takedown process for material believed to have been uploaded in error or in breach of copyright or other rights. Details of this process are available on each Record Page.
Third Party Content
Content on this site was provided by third parties. This Archive provides a platform for this content to be provided, but does not own or necessarily nor endorse it.
Users should be aware that certain words, terms, descriptions, or spellings contained in the third-party content on the website may be considered inappropriate today. They may have reflected the author or creator's attitude or the language used in the period that they were written.

Fees & Donations
Fees and donations received by The Photoline Archive are used to support the ongoing operation and development of the archive, including but not limited to hosting, storage, maintenance, software development, and related operating costs.
Paid services offered by The Photoline Archive are charged as one-time, non-recurring payments to your nominated payment method for the amount displayed on the website at the time of purchase.
Where applicable, paid services provide access to additional downloads or features for a specified period. At the end of that period, or once any included download allowance has been exhausted, your account will automatically revert to the standard Free User tier, including the normal monthly download allowance of 10 images.
Unused downloads or entitlements do not roll over beyond the applicable access period and will expire at the end of that period.
Additional download packages or paid access periods may be purchased once your current allowance has been exhausted or your existing paid period has expired.
The Photoline Archive may occasionally be unavailable due to maintenance, technical issues, or circumstances beyond our control. While we will make reasonable efforts to minimise disruption, uninterrupted availability of the service is not guaranteed.
Indemnity
To the fullest extent permitted by law, The Photoline Archive excludes all responsibility and liability in relation to the website and The Photoline Archive will not be responsible for errors, omissions or misstatements or be liable for any loss or damage however caused.
These Terms and Conditions are governed by the laws of New Zealand and users submit to the non-exclusive jurisdiction of the New Zealand courts.
